Terms of Service

1. Acceptance of Terms

By using LynxVPS services, you agree to these Terms of Service, our policies, and all applicable laws. If you do not agree, you must not use the services.

2. Services

LynxVPS provides hosting, VPS, and game server services. Billing and customer records may be managed through integrated third-party systems. You are responsible for your account security and all activity performed under your account.

3. Payments and Fees

Service charges are due according to your billing cycle. Past-due balances may result in suspension or termination. Abuse-related fees described below are administrative and remediation charges based on estimated response costs and are not a limitation on other legal or equitable remedies.

4. Acceptable Use and Abuse Policy

• Malware distribution, phishing activity, botnet operation, and unsolicited bulk messaging (spam) are prohibited.
• Spam and malware distribution each carry a $1,000 incident response fee per incident.
• Malware infections alone do not automatically trigger this fee. The fee applies when malware or spam is distributed intentionally or through negligent operation, including use of unsafe add-ons or failure to apply reasonable security updates on non-managed servers.
• For enforcement and billing, an incident means each distinct abusive act or campaign. Continuing or repeated abuse may be treated as a new incident for each 24-hour period or each materially separate campaign/event.

5. Restricted Content Policy (No Pornography)

• All pornography and adult sexual content are prohibited on LynxVPS services.
• Any hosting, distribution, or facilitation of pornography may result in immediate suspension or termination.
• Any illegal pornography, child pornography, or child sexual abuse material (CSAM) is strictly prohibited.
• Any CSAM or illegal pornography incident will result in immediate account cancellation, preservation of evidence, reporting to the NCMEC CyberTipline and relevant law-enforcement agencies (including the FBI where applicable), and a non-refundable $2,500 incident response fee per incident.

6. Enforcement

LynxVPS may suspend or terminate services immediately for violations, abuse, legal risk, or security threats. We may preserve and disclose logs, records, and evidence as required by law or to assist law enforcement.

7. Limitation of Liability

Services are provided on an as-available basis. To the maximum extent permitted by law, LynxVPS is not liable for indirect, incidental, special, consequential, or punitive damages arising from service use or interruption.

8. Changes to These Terms

We may update these Terms from time to time. Updated terms become effective when posted on this page. Continued use of services after updates constitutes acceptance.
